Who Is Liable in a Dog Bite Lawsuit?
Under CA Civil Code §3342, dog owners are held to a “strict liability” statute in cases of dog bites. This means that the owner of the animal is liable “regardless of the former viciousness of the dog or the owner's knowledge of such viciousness.” In other words, even if the animal did not display aggression prior to the attack, the dog owner is generally still liable for resulting injuries. This is true even if the dog bite occurred on the dog owner’s property.
